A 2-year-old boy was killed along with his mother, when they were struck by a train in Derry Borough in 2009. The father of the boy filed a wrongful death suit against the railroad company and the owner of the property where the accident occurred. The property owner is the city's volunteer fire department.
The mother was walking on the tracks with 2 of her children and pushing the 2-year-old boy in a stroller. The little boy's stroller became stuck, and the mother was caught in a frantic attempt to get her children to safety and avoid the onrushing train.
Thankfully, the two older children were spared. However, in what was likely a state of panic, the mother tried desperately to free her son's stroller - but she failed. Both were struck and killed.
The lawsuit claims the train company did not adopt a safe and effective warning system, and failed to sound a horn to warn the mother of the approaching train. It further claims the company failed to properly control the speed of the train, did not stop or slow the train to avoid a pedestrian crossing, and failed to put the brakes into emergency mode.
The local fire department is accused of not properly maintaining and repairing a hole in the fence, frequently used by the public to access businesses on the other side of the tracks. The accident was the second train-related fatality in Derry Borough in 2009.
The case will now proceed to trial, and locals will undoubtedly be ingrained with the horrifying images.
